Description:

Patent pledges are voluntary commitments made by patent holders to refrain from exercising some or all of the exclusive rights arising from their patents. This session will explore the history, legal theory and motivation behind some well-known patent pledges, with a focus on the recent Open COVID Pledge that has been made by some of the world's largest patent holders. Topics to be covered include enforceability, scope, duration and execution of these pledges and related licensing agreements, as well as alternatives such as patent pools and technology access programs.

Learning outcomes:

  • An understanding of the concept of patent pledges
  • The scope of patent pledges and how they are executed
  • How patent pledges are enforced
  • Relationships between patent pledges and licensing agreements
