This webinar offers an overview of IP developments and challenges in the countries of Eastern Europe, the Caucasus and Central Asia in view of the geopolitical turmoil following the escalation of the Russian-Ukrainian war in February 2022. Even though this part of the world is turbulent, it has always been a region of interest for brand owners keen to secure their IP rights in emerging markets. Effective IP management during uncertain times requires thorough preparation to maximize value and minimize potential problems.

Our presentation will cover recent developments in the realm of IP, spanning both national and regional perspectives. Within the regional scope , we will discuss Eurasian Patent Organization (EA- PO) that provides legal protection for inventions and industrial designs. Additionally, the forthcoming unitary Eurasian trademark system within the Eurasian Economic Union (EAEU) will be explored. While both systems were initially hailed as efficient and cost-effective approaches to simultaneous protection across the respective member states of E-APO and EAEU, we will delve into the question of whether these regional mechanisms remain effective tools for securing IP rights.

From the national perspective, the discussion will include recent developments in several countries, including the reorganization of the Ukrainian IP- O at the time of the war, as well as developments in the countries of the Caucasus, such as Azerbaijan and Georgia, and the Central Asian countries such as Kazakhstan and Uzbekistan.

Speakers:


Mayya Pak, PETOŠEVIĆ

Mayya is an IP practitioner and attorney at law specialized in the Eastern Europe and Central Asia region. She mostly handles trademark, copyright and industrial design enforcement and contentious matters. She also handles unfair competition cases and is actively engaged in the development of regional enforcement strategies. Leveraging her understanding of local laws, culture, and languages, Mayya provides guidance across a diverse range of industries, including food and beverage, fashion, technology, and entertainment. She is an active member of many well-known intellectual property organizations, such as INTA, AIPLA, AIPPI, and LES. Currently, Mayya is serving as a Co-Chair of INTA’s Judicial Administration and Trademark Litigation Subcommittee within the Enforcement Committee. In 2020, she was named a Trailblazer in WIPR Influential Women in IP, World Intellectual Property Review’s annual publication focusing on outstanding women in the IP industry. Having spent 27 years in the Eurasian region, she is currently based in New York.


 
Igor Alfiorov, PETOŠEVIĆ

Igor is an Associate at PETOŠEVIĆ Ukraine.  He handles various contentious and non-contentious IP matters in Ukraine and other countries in the region, with an emphasis on trademark prosecution and enforcement. He advises clients on IP protection and enforcement strategies and assists with issues in the advertisement, media and regulatory spheres. He represents clients before the Ukrainian IPO in various proceedings, including oppositions and well-known status recognition. Igor is also well versed in domain name dispute resolution under the UDRP. In 2021, Igor was appointed to serve as an arbiter in disputes under the UA-DRP, the Ukrainian variation of the UDRP. Igor also helped establish PETOŠEVIĆ’s newest office in Azerbaijan where he handles various organizational tasks as well as prosecution and enforcement of IP rights.


Taras Manolov, PETOŠEVIĆ

Taras is a Patent Attorney at PETOŠEVIĆ Ukraine.  He handles patent prosecution, enforcement and litigation in Ukraine and other countries in the region, and advises clients on all aspects of patent protection. He has extensive experience in preparing, filing and prosecuting patent applications in the fields of medicine, pharmacology, biotechnology and chemistry. Taras also handles the protection of plant breeder’s rights and the admission of plant varieties to national lists. Previously, Taras’s career in research and academia spanned 13 years and focused on bacterial pathogenicity, environmental biotechnology and bacterial biosensors. During this time, Taras worked as a researcher at the Max Planck Institute for Infection Biology in Berlin and at Lund University in Sweden, and as an engineer at the National Academy of Sciences of Ukraine. Taras also worked as a patent liaison for Ukrainian pharmaceutical company Yuria-Pharm.



Moderator: Ray Van Dyke, Van Dyke Intellectual Property Law

Raymond Van Dyke is an IP/Patent Attorney and Educator. In his practice he helps a variety of clients in their IP matters. He specializes in patent and trademark matters in various technologies, litigation, licensing, and procurement. After being a partner in big firms, he started his own IP consultancy in Washington, DC, with diverse domestic and international clientele and technologies, handling matters at the USPTO, Federal Circuit and local State and Federal courts. He teaches IP courses for engineers, business people and other professionals at the University of Maryland and George Mason University.  He has also taught at Southern Methodist University, American University, and across the world.  Ray also teaches at NIH and other institutions. He is the Senior Vice President of Special Events at LES and Chair of the LES DC Chapter; an AIPLA Fellow and former Chair of a number of Committees; Chair of the Montgomery County Bar Association IP Section, former Board Member of the DC Chapter of the ACM, former Board Member of ITechLaw (Computer Law Association); and continues his involvement in IPO, the MSBA, AIPPI, ABA, BIO, IEEE and other legal and technical organizations. Ray got his BS, MS in Computer Science and law degree from the University of North Carolina at Chapel Hill. He is licensed to practice in DC, MD, NY, NJ and TX, as well as the USPTO, and is a member of the U.S. Supreme Court, Federal, Second, Third, Fourth and Fifth Circuit Courts and a number of District Courts, Court of International Trade and Federal Court of Claims.  Ray also continues in his efforts to fight on behalf of the small inventor community in protecting the principles of the patent system.
