The recent decision in Appian v. Pegasystems raised eyebrows, as it awarded over $2 billion in damages for trade secret misappropriation. While the award itself is among the largest ever in an IP litigation, it occurred in the context of growing focus on trade secrets as a significant source of value both in companies’ operations and in the courtroom. This presentation will discuss some of the relevant takeaways from Appian against the broader backdrop of some recent developments in the area of trade secret damages. Speakers: Kevin McElroy Candice Cornelius Kevin McElroy is a Director at Stout. Kevin has 15 years of experience providing consulting services to corporations, law firms, laboratories, government organizations, universities, and individuals in the areas of intellectual property disputes, valuation, monetization, and other intellectual property management issues. He has been retained as an expert on economic damages in over a dozen matters, relating to the infringement or misappropriation of all classes of intellectual property assets and has had his opinions accepted in federal and local courts. Kevin has an undergraduate degree from Georgetown University and an M.B.A. from the Chicago Booth School of Business. He sits on LES’s IP Valuation Content Subcommittee. Candice Cornelius is a Director at Stout. Candice has over 9 years of experience valuing intellectual property and calculating economic damages. Candice has been retained as an expert on economic damages relating to patent infringement and trade secret misappropriation, among other claims.
