The ongoing pandemic has resulted in remarkable innovation with expedited strategic patenting and licensing, but, it has also impacted the performance and negotiation of licenses.
While providing the overall landscape of recent deals and any evolving trends in deal making, we will highlight exemplary cases that have impacted licensing including compulsory or royalty-free licensing of a patented invention and temporary open-source licensing of patent portfolios. A panel of licensing experts will examine the challenges encountered in licensing during a pandemic from three different perspectives including, academia, industry, and legal. The panel will discuss the effect of supervening events on licensing agreements, including minimum royalty provisions, mitigating risks via a force majeure clause, robust enforcement provisions, a "most favored licensee" clause in non-exclusive licenses, and possible alternative compensation to licensees.
