Join us for Part 3 of the IP Valuation in Special Situations webinar series, led by IP valuation expert and LES Board member, Efrat Kasznik, as she explores how IP is identified, valued, and divided in divorce proceedings. With approximately 50 percent of all U.S. (first or second) marriages ending in divorce, the proper identification and allocation of all marital assets is critical. Tangible assets, like bank accounts and real estate, are relatively straightforward to identify and value. On the other hand, IP assets, also referred to as “intangible assets,” are much more difficult to identify and value.  As a result, patents and other IP assets in divorce cases are often treated as an afterthought or are completely ignored. Using real-world case studies, Efrat will go over the steps for identifying and valuing intangible assets in divorce cases, what are some of the unique challenges when it comes to documenting the timeline and ownership, and what are some creative solutions for bridging the gap between the parties.

Efrat is an IP valuation and strategy expert with more than 25 years of consulting experience assisting clients with the valuation, strategic management and monetization of their intellectual property and technologies. She is president of Foresight Valuation Group LLC – a Silicon Valley-based IP valuation and litigation consulting firm – as well as a start-up advisory firm. Efrat is also an appointed lecturer on IP management at the Stanford Graduate School of Business (GSB), where she lectures on IP issues at the GSB’s MBA and executive education programs. Efrat specializes in analyzing IP and technology portfolios for a range of business transactions, including mergers and acquisitions, financial reporting, technology commercialization and business liquidations. She frequently testifies as an expert witness in legal cases involving damages or valuations of intellectual property and start-ups, as well as in high net worth divorce cases involving the valuation of intangible assets and technology startups. Efrat has been listed on the IAM 300 list of World Leading IP Strategists every year since 2013. She is actively involved in leadership roles with LES USA-Canada, where she currently serves as a board member, in addition to serving as Chair of the LES Silicon Valley chapter.

Lynn Dudinsky is Vice President of Foresight Valuation Group, an IP valuation, strategy, and economic consulting firm, where he has worked for the past decade to support clients in their development of an active approach to managing their intangible assets. Mr. Dudinsky’s work encompasses all areas where intellectual property and technology valuation is needed and has included M&A support, Investor/Startup support, Litigation services and Digital Asset valuations such as cryptocurrencies and other blockchain technologies.  Prior to joining Foresight, Mr. Dudinsky worked for the patenting group of Samsung Research America in Silicon Valley, where he performed research and evaluated inventions originating from Samsung’s labs and supported the efforts to secure global IP protection for Samsung, while interacting with cutting edge technology, many of which was in the wearable, software and IoT space. He also drafted patent applications and interacted with the USPTO while working for a patent prosecution firm during his time at Santa Clara School of Law.
