Brent Bersin, Senior Managing Director, Forensic & Litigation Consulting, FTI Consulting

For 30 years, Brent Bersin’s practice has focused on providing financial and economic consulting, damages quantification, valuation, and expert witness services to clients in the context of intellectual property and commercial disputes. He has significant intellectual property experience, which includes market assessments, valuation, licensing, and the calculation of reasonable royalties, lost profits, unjust enrichment and price erosion damages in matters involving unauthorized use of trade secrets, trademarks, trade dress, patents, and copyrights. Brent has also been recognized by Lexology (f/k/a Who’s Who Legal) as a Thought Leader USA – Commercial Litigation Expert Witnesses.

He has also assisted attorneys, investors, management and other stakeholders in assessing the value of early- and latter-stage technologies, patents, and intellectual property portfolios for various purposes including taxable transfers, sales transactions, licensing, intercompany transfers and collateral for financing transactions. Brent also possesses substantial experience providing economic analysis and expert testimony in complex commercial disputes, which have included issues of lost profits, breach of contract, restrictive covenant violations, valuation, breach of fiduciary duty, unfair competition, lost business value, tortious interference, false advertising, fraud, noncompetes/restrictive covenants, alter ego, post-acquisition and purchase price disputes, “ability to pay” disputes, and business interruption. Brent has been designated and testified as an expert witness in Federal Court, State Court, Bankruptcy Court, and arbitration matters. He has also presented and been published frequently on the topics of economic damages, and valuation, financial, and forensic
accounting issues.

 
Rebekah Bezerra, Senior Director, Forensic & Litigation Counseling, FTI Consulting

Rebekah Bezerra has over a decade of experience in providing economic analysis in intellectual property matters and commercial disputes. Rebekah has assisted clients on engagements involving patent infringement, trademark infringement, copyright infringement, misappropriation of trade secrets, fraud, breach of contract, and breach of fiduciary duty. She has collaborated with clients across various industries, including oil and gas, retail and consumer goods, electronic gaming, e-commerce, and telecommunications.
Rebekah has reported and given deposition testimony in trade secrets litigation matters.

Rebekah also works closely with FTI’s testifying experts to quantify economic damages in intellectual property matters and commercial disputes. She assists in managing all aspects of an engagement from the moment an engagement letter is executed through trial. Rebekah occasionally participates as a guest lecturer on economic damages related to intellectual property at South Texas College of Law Houston.

Rebekah holds a B.B.A. degree with a triple major in Accounting, Business Administration, and Spanish from Houston Christian University, an M.B.A. from the Cox School of Business, Southern Methodist University, and a J.D. from Dedman School of Law, Southern Methodist University.
