Modules: - Background & Overview: Establish foundational concepts of IP rights, infringement types, and general damages frameworks.
- Damages Approaches & Calculations: Provides a detailed examination of the key damages methodologies in IP cases, focusing on lost profits analysis (including Panduit factors), reasonable royalty calculations (including Georgia-Pacific factors and comparable license analysis), and unjust enrichment measures. This module emphasizes proper apportionment, documentation of assumptions, and recent case law developments affecting damages calculations, while providing practical guidance on selecting and implementing appropriate damages approaches based on case-specific circumstances.
