Level: Intermediate – Some experience, typically 1-3 years, with IP licensing and interest in specific topics.

Description: This course provides a comprehensive foundation for all IP professionals to understand both the theoretical framework and practical application of IP damages calculations, enabling attendees to effectively engage with damages experts and assess damages strategies in IP disputes. The content incorporates practical examples, relevant case insights, and best practices used by damages experts to quantify and support defensible damages opinions.

Modules:

  • Background & Overview: Establish foundational concepts of IP rights, infringement types, and general damages frameworks.
  • Damages Approaches & Calculations: Provides a detailed examination of the key damages methodologies in IP cases, focusing on lost profits analysis (including Panduit factors), reasonable royalty calculations (including Georgia-Pacific factors and comparable license analysis), and unjust enrichment measures. This module emphasizes proper apportionment, documentation of assumptions, and recent case law developments affecting damages calculations, while providing practical guidance on selecting and implementing appropriate damages approaches based on case-specific circumstances.

You will learn the following:

  • Fundamental framework for calculating damages across different types of IP (patents, trademarks, copyrights, trade secrets), including key methodologies like lost profits, reasonable royalty, and unjust enrichment
  • Practical application of key damages concepts like the Georgia-Pacific factors, Panduit factors, and apportionment principles, supported by relevant case law and real-world examples
  • How to analyze and present damages evidence, including relevant and acceptable comparable license information, cost considerations, and burden-shifting between parties in different damages contexts
  • Technical aspects of damages calculations including cost analysis, market share approaches, price erosion, and convoyed sales
  • Strategic considerations for different damages theories and how to match appropriate remedies to specific IP claims while avoiding double recovery
